By-law Resolutions 2017

By-law No. 1 – Permits and Penalties – Amendment

NOTICE is hereby given that the Renmark Paringa Council, at its meeting held on Tuesday, 24 October 2017, resolved as follows:

That pursuant to Section 246(5) of the Local Government Act 1999 and for the purposes of clause 9 of the Council’s Permits and Penalties By-law 2017, the Council resolves that the expiation fees for offences under its By-Laws are fixed as follows;

  • By-Law 2 Local Government Land                  $187.50
  • By-Law 3 Roads                                               $187.50
  • By-Law 4 Moveable Signs                               $187.50
  • By-Law 5 Dogs                                                 $187.50
  • By-Law 6 Cats                                                  $187.50

And, pursuant to section 246(3)(g) of the Local Government Act 1999, to fix a further penalty of $50 for every day on which the offence or breach of the by-law continues.

By-law No. 2 – Local Government Land – Amendment

NOTICE is hereby given that the Renmark Paringa Council, at its meeting held on Tuesday, 24 October 2017, resolved as follows:

In exercise of its power contained in section 246(3)(e) of the Local Government Act 1999, the Council resolves as follows:

1.      that clause 9.10.5 of the Local Government Land By-law No. 2, which provides that a person must obtain permission from the Council to moor a boat to specified land, applies to all Local Government Land except:

1.1.       the riverfront mooring sites between Twelfth Street and Pyap Street;
1.2.       the New Landing Way reserve area

which areas are delineated in the maps contained in Appendix A*;

In exercise of its power contained in section 246(3)(e) of the Local Government Act 1999, the Council resolves as follows:

2.      that, for the purposes of clause 9.10.6 of the Local Government Land By-law No.2 –, the Council resolves that the condition to be contained on signage on Local Government Land with which a person who moors a boat on or to that land must comply is:

"A boat must not be moored on or to Local Government Land within this area for more than 96 hours in any 14 day period without Council permission".

In exercise of its power contained in section 246(3)(e) of the Local Government Act 1999, the Council resolves as follows:

3.      that clause 9.15.1 of the Local Government Land By-law No.2 –, which provides that a person must obtain permission from the Council to erect a tent or other structure of calico, canvas, plastic or similar material as a place of habitation on Local Government land, applies to all Local Government Land in the Council's area except the portion of land within Plush’s Bend Recreation Area, Plush’s Bend Road that is delineated in the map marked as Appendix B*;

In exercise of its power contained in section 246(3)(e) of the Local Government Act 1999, the Council resolves as follows:

4.      that, for the purposes of clause 9.15.2(b) of the Local Government Land By-law No.2 –, which permits camping on designated Local Government Land in accordance with conditions determined by the Council, the Council resolves that:

4.1.       the portion of land within Plush’s Bend Recreation Area, Plush’s Bend Road outlined in the attached map marked as Appendix B* is a designated area where camping in a tent or similar is permitted; and
4.2.       the condition to be contained on signage on designated Local Government Land with which a person who camps on that land must comply is "A person must not camp within this area for more than 7 days within any 28 day period without the permission of the Council".

In exercise of its power contained in section 246(3)(e) of the Local Government Act 1999, the Council resolves as follows:

5.      that, for the purposes of clause 9.15.3(a) of by-law No.2 – Local Government Land, which permits camping in a self contained vehicle on designated Local Government Land, the Council resolves that the following are designated areas:

5.1.       the portion of land within TM Price Rotary Park, Renmark Avenue, Renmark ;
5.2.       the portion of land within SS Ellen Park, Thayne Terrace, Lyrup ;
5.3.       the portion of land within Bert Dix Park, Lock 5 Road, Paringa; and
5.4.       the portion of land within Plush’s Bend Recreation Area, Plush’s Bend Road;

which areas are delineated in the maps contained in Appendix C*;

In exercise of its power contained in section 246(3)(e) of the Local Government Act 1999, the Council resolves as follows:

6.      that, for the purposes of clause 9.15.3(b) of by-law No.2 – Local Government Land, which requires persons who camps in a motor home on designated Local Government Land to comply with certain conditions, Council resolves that a person who camps in a self contained vehicle in the designated areas (i.e. being the areas described in paragraph 5) must comply with the following conditions that will be contained in signage on the land:

6.1.       in all cases, a condition that permits camping in a self contained vehicle in the area for no more than 72 hours in any 14 day period; and
6.2.       in the case of signage located on the designated area within SS Ellen Park, Thayne Terrace, Lyrup, a condition that requires payment of the applicable fee to camp in that area as specified in the Council’s Schedule of Fees and Charges from time to time;

By-law No. 5 – Dogs – Amendment

NOTICE is hereby given that the Renmark Paringa Council, at its meeting held on Tuesday, 24 October 2017, resolved as follows:

In exercise of its power contained in section 246(3)(e) of the Local Government Act 1999, the Council resolves as follows:

7.      that clause 9.1 of the Dogs By-law No.5 , which requires dogs to be on-leash in specified places, applies to the following areas:

7.1.       all Riverfront Reserves between New Landing Way reserve area and Patey Drive;
7.2.       Bert Dix Park, Lock 5 Road, Paringa;
7.3.       Plush’s Bend Recreation Area, Plush’s Bend Road Renmark;
7.4.       Darnley Taylor Park, Renmark Avenue, Renmark;
7.5.       Madigan Reserve, Wattle Street, Renmark;
7.6.       SS Ellen Park, Thayne Terrace, Lyrup; and
7.7.       TM Price Park, Renmark Avenue, Renmark

that are delineated in the maps contained in Appendix D*; and

In exercise of its power contained in section 246(3)(e) of the Local Government Act 1999, the Council resolves as follows:

8.      that clause 10.2 of by-law No.5 – Dogs, which relates to dog-prohibited areas, applies to the following areas:

8.1.       the whole of the land comprising the Renmark Swimming Pool, located at Cowra Street, Renmark;
8.2.       Playing Surfaces of the Renmark Ovals No 1, 2 & 3 and Tennis Court playing surfaces, Paringa Street, Renmark;
8.3.       Renmark Netball Courts, Corner Paringa Street and 15th Street, Renmark;
8.4.       Paringa Oval Playing Surface, Sturt Highway, Renmark; and
8.5.       Lyrup Oval Playing Surface, Downer Street, Lyrup

that are delineated in the maps contained in Appendix E*.
